These terms govern your use of samdyatt.com and any services booked through it, provided by Dyatt Technology Consulting, operating as Sam Dyatt Systems ("we," "us," "Sam Dyatt Systems"), based in the Austin, Texas area. By booking a call, engaging our services, or using this site, you agree to these terms.
We provide technology consulting for small businesses, including network and security setup, systems and identity management, Toast POS implementation and support, and AI and automation training, as described on this site. Specific pricing and scope for a given engagement are as quoted at booking or in a separate written proposal or service agreement.
The Small Business Systems & Security Audit is guaranteed: if it doesn't identify at least three concrete, fixable issues, or five or more hours a week you could win back, the audit fee is refunded in full. This guarantee applies only to the flat-fee audit itself, and not to implementation or retainer work.
To do the work well, we need your cooperation. That includes providing timely access to systems, accounts, or premises as needed for an engagement, giving accurate information about your environment, and designating someone available to answer questions during the engagement. Delays caused by lack of access or information may affect timelines outlined in a proposal.
Configuration work, documentation, and training materials created specifically for you as part of a paid engagement become yours to use for your business once paid in full. Our own internal tools, templates, and methodology remain our property and may be reused for other clients.
We treat information about your business, systems, and data as confidential, and will not disclose it to third parties except as needed to perform the engagement (for example, working with a vendor you use, like Toast) or as required by law.
We provide our services with reasonable care and skill, based on the information and access you provide. We do not guarantee that any system will be completely free of vulnerabilities or failures — no consultant can promise that. To the fullest extent permitted by law, our total liability for any claim arising from our services is limited to the fees you paid us for the specific engagement giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages (such as lost profits or lost data) arising from our work.
Sam Dyatt Systems acts as an independent contractor, not an employee, partner, or agent of any client, and nothing in these terms creates a joint venture or partnership.
You may not use this site to transmit anything unlawful, attempt to gain unauthorized access to our systems, or scrape or reproduce site content for commercial use without permission.
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Williamson County or Travis County, Texas.
We may update these terms from time to time. Continued use of the site or booking of services after an update means you accept the revised terms.
